BUTTERWORTH: Three policemen claimed trial in the Sessions Court here today to raping and committing carnal intercourse against the order of nature on an Indonesian woman in Perai last Friday.
Constables Remy anak Dana, 25, and Syarihan Romli, 21, and Corporal Nik Sin Mat Lazin, 33, were charged with raping the 25-year-old woman at Room Four of the Perai Police Barracks here between 6.40am and 7.30am on Nov 9.
They were charged under Section 376 (1) of the Penal Code which provides for a maximum 20-year jail term and whipping upon conviction.
They were also charged with committing carnal intercourse against the order of nature on her at the same time and place, under Section 377C of the Penal Code which also provides for a maximum 20-year jail term and whipping upon conviction.
The prosecution, represented by DPP Suhaimi Ibrahim, did not propose bail on the grounds that the witnesses of the accused were fellow policemen.
However, he said, if the court allowed bail, then the prosecution would propose RM30,000 with one surety for each of the accused.
Judge Nabisha Ibrahim allowed bail of RM25,000 with one surety for each of the accused and ordered them to report to the nearest police station every month, and set Dec 12 for the trial.
The three accused posted bail.
Nik Sin and Syahiran were represented by counsel Parmjit Singh and Remy, by counsel Anthony Samy.
